More than 12 million UK motorists awaiting compensation for mis-sold car finance agreements face a potentially extended wait, the Financial Conduct Authority (FCA) has warned. Legal challenges are understood to be the primary cause of the potential delays, pushing back the anticipated timeline for payouts.

The FCA previously estimated that around 12.9 million customers may have been affected by widespread mis-selling of car finance between 2008 and 2020. This followed a review prompted by concerns about discretionary commission arrangements (DCA) – where brokers were incentivised to prioritise certain lenders, potentially leading to customers receiving less favourable deals.

In January 2024, the High Court heard that a significant number of firms are disputing the methodology used to calculate compensation. This dispute centres on how interest rates should be assessed when determining the level of redress owed to affected customers. The FCA has stated it is working to resolve these challenges as quickly as possible, but the ongoing legal proceedings are creating uncertainty.

The initial deadline for firms to submit claims was the end of August 2023. However, the complex nature of the claims and the legal disputes mean that the process of assessing and distributing compensation is proving more protracted than initially anticipated. The FCA has urged firms to continue engaging constructively with the process and to prioritise the fair and timely resolution of claims.
